In using this website or our services you are deemed to have read and agreed to the following terms and conditions:

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Creative Miles’s terms and conditions. “Creative Miles”, “Ourselves”, “We” and “Us”, refers to Creative Miles. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of Creative Miles stated services/products, in accordance with and subject to, prevailing English Law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same. Privacy Statement
We are committed to protecting your privacy. Authorized employees within Creative Miles on a need to know basis only use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers. Parliament has created specific offences for unauthorised actions against computer systems and data. We will investigate any such actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.

Confidentiality
Client records are regarded as confidential and therefore will not be divulged to any third party, other than Creative Miles if legally required to do so to the appropriate authorities. Clients have the right to request sight of, and copies of any and all Client Records we keep, on the proviso that we are given reasonable notice of such a request. Clients are requested to retain copies of any literature issued in relation to the provision of our services.

Where appropriate, we shall issue Client’s with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties. We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by Creative Miles or Dream Rack will only be in connection with the provision of agreed services and products.

Cookies 
Like most interactive web sites Creative Miles website [or ISP] uses cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate partners may also use cookies.

Billing and Payments
All invoices are generated 7 days before the due date, a digital copy of the invoice is sent to your registered email address. It is your responsibility that the email address is kept up to date so that you can receive emails from us. All services must be renewed/paid for before the due date assigned to the invoice.

Unless stated below, failure to renew your services this will result in an automatic service suspension after 3 days until the invoice has been cleared. It is your responsibility that the invoice is paid before the due date to prevent any service interruption.

You have 30 days to renew your service or services on the event your unable to pay on the due date, after which if the service is not renewed after 30 days we reserve the right to terminate the services without backup or notification. It is your sole responsibility to make sure any files/content are fully backed up.

Unless stated all payments must be received in UK Pound Sterling, if you pay by an alternative currency you are responsible for fees that may accrue.

We reserve the right to alter prices at any time and will notify you of any alteration by providing you a written notice. This notice will be sent to your registered email address so it is your responsibility this is kept up to date.

You warrant that you are lawfully authorized to make a payment using the payment method chosen. In the event where you are not the named cardholder, you acknowledge that you and the named cardholder both accept these terms and conditions and jointly and severally liable for any payment(s) due. You hear by indemnify us in the vent that the cardholder or issuer declines any transaction for payment including costs in recovering the outstanding balance due.

If you attempt to charge-back or distribute the transaction with the payment gateway, we reserve the right to suspend your services with immediate effect until the chargeback has been reversed in our favor.

Dedicated servers must be renewed on the 29th of each month without failure, failing to make a payment on the due date will result in your server being removed or cancelled without prior notice, we are not responsible for any data/services you may have been running.

Domain names expire on the due date, it is important you make a payment 48 hours before this date so that the domain name can be renewed before it expires, failure to to make a payment before the domain expiry date may result in additional charges recovering the domain name.

Over Usage
Account usage is monitored frequently. All accounts will receive a notification when bandwidth, disk-space or process usage is near accounts limit. Over usage will result in an automatic suspension unless a prior agreement has been reached.

Fair Use Policy
We operate a fair use policy for all services.

By “Fair Use” we mean to ensure that not any one client can consume all available system resources on any given machine or whereby the client uses the system in a way it was not originally intended to be used. Shard Hosting; We divide, Disk-space, CPU, Memory and Bandwidth between all uses on our shared hosting platform, to prevent service interruption for other users we reserve the right to suspend your service at anytime without notification.

In most cases, majority of the accounts never reach unacceptable fair usage. In the event you do breach the fair use policy we will work close with the client and suggest alternate methods of providing a service to you where available.

Reseller Hosting
If not specifically stated to the contrary, our reseller web hosting services are intended to be used for the purposes of hosting websites and e-mail. Batch processing, video encoding/transcoding, web crawling/spidering, archiving and online backup systems and any system designed to consume memory, CPU or disk resources for purposes other than hosting a website are not permitted on our reseller hosting platform. However you may use such tools on our VPS or Dedicated servers where available.

You as a reseller are solely responsible for all accounts and content associated with your account, we reserve the right to suspend your account or account(s) associated with the account at anytime without notice. By using any of the products and services we offer you thereby indemnify Creative Miles, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.

You as a reseller are responsible for ensuring that your customers are bound by terms and conditions that reflect and give effect to the terms and conditions on our website.

All accounts are subject to our “Fair Use Policy”, including whereby the term “Unlimited” is used.

  • To host adult content such as videos or images on our shared hosting platform is not allowed.
  • No Warez / Hacking / Phishing Sites
  • No mass mailing/sending scripts allowed.
  • We do not allow any file/image sharing scripts
  • Website Chats, proxys and file downloading scripts are not allowed.
  • Paid to surf, auto surf, buxto and any other similar scripts are not allowed.
  • Nulled software such as IP.Board, vBulletin or any other kind without correct licensing is not allowed.
  • Using your account to store files only other than a website content is not allowed.
  • Sites related to torrenting/tracking is not allowed.
  • Any malicious scripts that may cause service disruption or cause harm to other third party services is not allowed.
  • You may NOT use your reseller account to give away free hosting, you must charge a minimum of £1, $1

Shared Hosting
If not specifically stated to the contrary, our shared web hosting services are intended to be used for the purposes of hosting websites and e-mail. Batch processing, video encoding/transcoding, web crawling/spidering, archiving and online backup systems and any system designed to consume memory, CPU or disk resources for purposes other than hosting a website are not permitted on our shared hosting platform. However you may use such tools on our VPS or Dedicated servers where available.

All accounts are subject to our “Fair Use Policy”, including whereby the term “Unlimited” is used.

We reserve the right to suspend any accounts that may cause a disruption to our service or that may cause instability with our services or break the rules above. If you believe your website may consume abnormal amounts of resources or usage you must contact us immediately to discuss the suitability of your hosting environment.

Dedicated Servers
By renting a dedicated server you accept that your sole responsible for its content and services that may be installed on it, it is your responsibility to make sure that the server your using has the necessary security such as Firewalls and Software updates to prevent network and software attacks.

We do not take any backups of dedicated servers, it is your responsibility to make sure you retain a backup or backups of your data; it is your responsibility to prevent any data loss.

Under no circumstances shall you infringe on the integrity of the server hardware or network and will be hold responsible should any damage occure to the machine or network.

All accounts are subject to our “Fair Use Policy”, including whereby the term “Unlimited” is used.

You may not use the server to:

  • Sending bulk emails such as spam, abuse or any other content.
  • Distributing Illegal files and images such as pirated software, music, videos and any other content that is Illegal.
  • Hosting Warez / Hacking / Phishing Sites
  • Sites related to torrenting/tracking is not allowed.
  • Any malicious scripts that may cause service disruption or cause harm to other third party services is not allowed.
  • Modify the machine configuration settings such as BIOS or any other hardware.

We reserve the right to disconnect/cancel or remove the service without prior notification. Using the server for malicious or illegal activity will result in your account being suspended immediately without notice and the server being removed.

Cancellation, Refunds, Termination and Disputes
Minimum 24 hours notice of cancellation required. Notification for instance, in person, via email, mobile phone ‘text message’ and/or fax, or any other means will be accepted subject to confirmation in writing. We reserve the right to levy a £30 charge to cover any subsequent administrative expenses.

No cash refunds will be granted unless the payment has been taken in error. Refunds for prepaid services such as VPS or Dedicated servers shall be granted where there is a genuine irreconcilable problem with the service and at the management’s discretion. Any breach of our terms and conditions will result in an immediate termination with no refund.

Setup fees are non-refundable. Any disputes should be expressed in writing via a valid contact method as listed on our contact page.

Under no circumstances will we tolerate threatening or abusive behaviour towards our staff; we reserve the right to terminate any service or services with immediate effect without notice.

Should the client during the course of a telephone conversation, email, support ticket or social media make the reference to “legal action” or say anything we might reasonably understand to imply or infer that the client may intent to pursue a legal claim against us, we reserve the right to refuse telephone support going forward. Any further communication between the client and us must be sent via email or support ticket.

Should we feel that your needs may be better served by another provider, we reserve the right at our sole discretion to terminate any service or services. Where it is reasonable to do so we will provide a 30 days’ notice of termination and provide a full backup of all website content and email.

Both the Client and ourselves have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes, underway.

Domain Registration, Renewal
Some of our hosting packages include a free domain name or transfer for .UK domain names. All other extensions are excluded from this offer due to their additional cost however if you would like to use a domain name that is excluded from this agreement please contact us for a reduced price.

We will always register, transfer and renew domain names in our clients name – never our own. You are always in control of every aspect of your domain name(s) and can manage your domain name through our billing control panel. It is your responsibility to keep this data correct.

Disclaimer Exclusions and Limitations 
The information on this web site is provided on an “as is” basis. To the fullest extent permitted by law, Creative Miles: excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or Creative Miles literature; and Excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised Creative Miles of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

Creative Miles does not however exclude liability for death or personal injury caused by its negligence.
The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.

Service Availability
Unless otherwise stated, the services featured on this website are only available within the United Kingdom, or in relation to postings from the United Kingdom.

All advertising is intended solely for the United Kingdom market. You are solely responsible for evaluating the fitness for a particular purpose of any downloads, programs and text available through this site. Redistribution or republication of any part of this site or its content is prohibited, including such by framing or other similar or any other means, without the express written consent of Creative Miles.

Creative Miles does not warrant that the service or services we provide will be uninterrupted, timely or error free, although it is provided to the best ability. By using this service you thereby indemnify Creative Miles, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.

Products and Services
It is the clients sole responsibility to check the services or products are fully functional on completion, this includes websites and/or shopping carts, shared web hosting, dedicated servers and any/other service not listed above. We require a 48 hours notice to correct any issues that may be outstanding.

By using any of the products and services we offer you thereby indemnify Creative Miles, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.

Third Party Plugins and Software
We can not be held responsible for third party plugins or software that has been installed on opensource platforms such as WordPress, Opencart and any other software we provide with our service. It is the customers sole responsibility to make sure the plugins are updated working correctly.

Notification of Changes 
Creative Miles reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. If there are any changes in how we use our site customers’ Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change. Any changes to our privacy policy will be posted on our web site 30 days prior to these changes taking place. You are therefore advised to re-read this statement on a regular basis

These terms and conditions form part of the Agreement between the Client and ourselves. You’re accessing of this website and/or undertaking of a booking or Agreement indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.

Fraud
We may use your contact information such as name, email address, phone number and IP address to perform random fraud checks on a frequent basis with Fraud Record (https://www.fraudrecord.com) to view your history with any hosting services you may have ordered.

All clients are subject to random fraud checks at an interval of our choice.

We reserve the right to cancel or terminate any orders without refund that are suspected to be related to fraudulent activity, or misrepresentation. If you are found to have been suspected of fraud, you will be reported to Fraud Record with notification or prior warning.
